LIABILITY WAIVER AND RELEASE OF LIABILITY AGREEMENT

1. ACKNOWLEDGMENT OF RISKS

I, the undersigned participant, acknowledge that participation in Grappling with the Word (“Program”) involves activities that may include physical exertion, emotional and mental challenges, and other inherent risks. These risks can result in injury, illness, or property damage. I voluntarily assume all risks, known and unknown, associated with my participation.

2. PERSONAL RESPONSIBILITY

I agree to act responsibly at all times, follow the Program’s rules, guidelines, and instructions, and take full responsibility for my own safety and actions while participating.

3. MEDICAL CONDITIONS

I represent and warrant that I have no medical conditions, injuries, or limitations that would make participation in the Program unsafe. I acknowledge that it is my responsibility to consult a physician prior to participation if I have any medical concerns. I understand that the Program is not responsible for assessing my fitness to participate.

4. RELEASE OF LIABILITY FOR INJURY

In consideration for being allowed to participate in Grappling with the Word, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue Grappling with the Word, its owners, officers, instructors, employees, volunteers, agents, and affiliates (“Released Parties”) from any and all liability, claims, demands, or causes of action of any kind, whether known or unknown, arising out of or relating to any injury, illness, death, or property damage sustained while participating in the Program, including but not limited to claims arising from the negligence of the Released Parties.

5. PROPERTY DAMAGE

I accept full responsibility for any damage I may cause to facilities, equipment, or property of Grappling with the Word, whether accidental or intentional, and agree to reimburse the Program for any costs associated with such damage.

6. SUPERVISION & INSTRUCTION

I acknowledge that instructors, staff, and volunteers provide guidance, instruction, and supervision, but that I am ultimately responsible for my own safety and conduct during all Program activities.

7. MEDIA RELEASE

I grant Grappling with the Word and its affiliates the right to photograph, video record, or otherwise capture my likeness and use such media for promotional, educational, or any lawful purpose, without compensation or further notice.

8. INDEMNIFICATION

I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost, including reasonable attorney’s fees, arising from my participation in the Program or my violation of this Agreement.

9. SEVERABILITY

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

10. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the state/province in which Grappling with the Word operates, without regard to conflict of law principles.
